The appellate section of Baird Williams & Greer, LLP is distinguished for preserving successful trial judgments on appeal, or artfully and effectively challenging lower court outcomes. Baird Williams & Greer, LLP appellate attorneys are a resource for their own clients, and for other law firms seeking experienced appellate counsel.

Appellate courts review lower court judgments with ordinarily one thing in mind - whether the appellate court has discretion to correct the error alleged by the appellant. Baird Williams & Greer, LLP appellate attorneys are practical in their approach to appeals, and objectively advise clients of the likelihood of prevailing on review. Tilting at windmills is not what most Baird Williams & Greer, LLP clients desire. But when an appeal is appropriate, or when defending a judgment from an appeal is necessary, Baird Williams & Greer, LLP attorneys maximize clients' opportunities to prevail.

Appellate success is found throughout the firm, starting with founding partner Daryl Williams. Daryl has argued before the U.S. Supreme Court, on motion by former Solicitor General Rex Lee. Robert Greer heads the Appellate section, with extensive appellate practice and numerous reported decisions. Robert's cases have literally changed the landscape of Arizona state law. Reported decisions include: Adiutori v. Sky Harbor Intl. Airport, 880 F. Supp. 696 (D.Ariz. 1995) aff'd in table form, 103 F.3d 107 (9th Cir. 1996) (Americans with Disabilities Act as applied to airport transportation system); Law v. Superior Court of Arizona, 157 Ariz. 147, 755 P.2d 1135 (1988) (adopting seat belt defense in Arizona); Broadbent v. Broadbent, 184 Ariz. 74; 907 P.2d 43 (1995) (abolishing parental immunity in Arizona), Parker v. Vanell, 170 Ariz. 350; 824 P.2d 746 (1992) (construing new comparative negligence statute); Garcia v. General Motors, 195 Ariz. 510, 990 P.2d 1069 (App. 1999) (seat belt defense in conflicts between state laws).

Craig LaChance clerked for Judge Susan Ehrlich of the Arizona Court of Appeals, Division One (2001-2002). Craig has argued a number of the preliminary motions for Baird Williams & Greer, LLP's representation of counsel in the $500 million dollar Baptist Foundation of Arizona criminal defense trial. Michael Blair has participated in a number of appeals and petitions for review to the Arizona State Supreme Court. Michael has twice appeared and argued before the Arizona Court of Appeals.

Jim Reed has briefed numerous appeals before all levels of state and federal court, including before the U.S. Supreme Court. He has argued before the Ninth Circuit Court of Appeals, the Arizona and Pennsylvania Courts of Appeal, and before the Nevada State Supreme Court on a precedent-setting construction law appeal adopting the "Joint Check Rule" for payments by project owners and general contractors.

Successful appellate practice relies upon familiarity with the lower court record, the assembly of accurate and persuasive legal grounds for appeal or defense, and the ability to succinctly mesh those areas into a compelling argument. Baird Williams & Greer, LLP attorneys have all of those abilities and experience. Baird Williams & Greer, LLP attorneys are skilled at resolving disputes without the need for appeal, and when necessary, to protect a client's rights upon review. Baird Williams & Greer, LLP advises clients on a prudent, targeted, economical approach to appeals. It is the reason that, at Baird Williams & Greer, LLP, appellate success is both pursued and expected.
