Every business and every family needs insurance to protect them against calamity. How much and what kind of protection is given depends upon what the policyholder intended and expected and what the insurer wrote in the policy. Sometimes, there is a wide difference between the two. At Baird, Williams and Greer, we have more than twenty-five years experience in interpreting insurance policies, giving opinions as to what is covered, making recommendations on dealing with insurance claims and litigating coverage questions and bad faith.

We have represented aviation, commercial general liability, trucking, homeowners, and automobile insurance carriers and have represented businesses and individuals who disagree with insurance companies' decisions. On either side, the questions are the same:

• How do the facts compare to policy provisions and the law?
• What were the consumers' reasonable expectations of    coverage?
• Is the evaluation impartial?
• Is the entire picture seen?
• Are we relying upon unsubstantiated opinion or hearsay?
• Are future investigations needed?
• Are experts needed to understand the technical aspects of the    matter?
• How will a court or jury see the situation?

Robert Greer has worked in-house for insurance companies, as well as representing self-insured companies and insurers. Mr. Greer has prosecuted and defended claims against insurance companies for coverage and bad faith. Most recently, Mr. Greer obtained a judgment in excess of $4.5 million against the world's largest insurer for bad faith handling of directors and officers' claims.

Insurance litigation is complex, time-consuming and risky. The Firm's philosophy is to attempt to dispose of litigation matters expeditiously and economically, whether through dispositive motions or alternative dispute resolution or credible negotiations. But some cases must be tried. There is no substitute in negotiation for experienced counsel who have seen both sides of a conflict and are thus better able to represent either. There is no substitute in trial for counsel who have tried dozens of cases and have no fear of the courtroom.
